TripDoctor Terms and Conditions

These terms and conditions govern the use of the TripDoctor insurance LLC. (“TripDoctor” or “the company”) website found at https://tripdoctor.com/insurance or at any other websites or webpages controlled by TripDoctor (the “website” or “site”). By using the site, you (“you”, the “user”, the “applicant”, the “customer”) are indicating your understanding, acceptance and acknowledgment of these terms and conditions. If for any reason you disagree with this terms and conditions, leave the site and do not return to it. At any time, subject to its discretion, TripDoctor’s terms and conditions are subject to change. The continued use of the site after any changes to these terms and conditions constitutes your understanding, acceptance and acknowledgment of any and all changes. TripDoctor advises all users to refer to these terms and conditions frequently to monitor for updates or changes.

Site Access

Accessing the Site or its respective resources, may require providing certain personal information (“PI”). As a condition of using the Site, you agree that any and all information you provide on the Site will be current, correct, and complete. In the event that TripDoctor has reason to believe that this is not the case, the Company has the right to refuse access to the Site or any of its respective resources, and, at any time, to terminate or suspend the User’s account with, or access to, the Site. Other services of the Site, including, but not limited to, applying for insurance coverage, may be regulated by the terms and conditions and / or privacy policies of other websites and their respective owners. All Users should also review the terms and conditions and or privacy policies of other websites carefully.

Restrictions on Use

The User may access and use the Site for only for the purpose of inquiring about, applying for or obtaining insurance for their personal or legitimate business purposes. Users may not use the Site or any of its respective content, for any other purpose without TripDoctor’s prior written consent. TripDoctor’s written consent is required for all other purposes outlined below, but not limited to those listed below:

1. Any re-selling, co-selling or co-branding with the Site including the use of hyperlinks directing traffic to this Site
2. The use of the TripDoctor trademarks such as logos, taglines, messaging, phraseology, formatting, among others.
3. Data mining the Site through the use of a person to manually copy and transmit data, cut and paste, automated scraping tools, bots, data mining, or any tool, script, application, or process to do the same

In the event of violation of the above, violators will cooperate fully with TripDoctor by ceasing all unauthorized activity immediately. If unauthorized use continues after TripDoctor gives notice of said violation, the violating User agrees to reimburse TripDoctor for any and all expenses or costs associated with pursuing the Company’s rights to end the unauthorized use.

Privacy Policy

TripDoctor treats all personal information submitted on the Site in accordance with TripDoctor’s Privacy Policy (also found on the Site) which is incorporated into and therefore made a part of this Terms and Conditions. TripDoctor’s Privacy Policy is subject to change at any time, and all Users are encouraged to review the Privacy Policy from time to time and especially at times when they may enter any information onto the Site.

Use of Proprietary Information

Any content viewable or accessible from the Site and any other website that TripDoctor, or any of its subsidiaries or parent organizations owns, controls, operates, or licenses ( “Content”) is the property and proprietary information of TripDoctor and / or any third party that provided TripDoctor with said Content. TripDoctor or such third party retains the rights, titles and interests in this Content. Accordingly, content on this Site may not be replicated, copied, uploaded, downloaded, distributed, published, transmitted manually, digitally or in any other way without TripDoctor’s prior written consent. As such, the User may not disclose any such information. The User must destroy, permanently delete or return this information when requested by TripDoctor.

Consent on the Use of Inputs

For Users to fully enjoy their use of the Site, all Users hereby grant TripDoctor with the worldwide, perpetual, royalty-free, irrevocable, non-exclusive license and right to use, adapt, modify, publish, reproduce, translate, distribute, display, perform, create from any and all comments, feedback, remarks, stories, reactions, content, inputs, ideas, or inventions, methods, processes, algorithms or any other data or information sent, uploaded, inputted or communicated to TripDoctor through the Site (collectively referred to as “Inputs”). This includes the incorporation of any Inputs into the Site or any other works, media or technology at the Company’s discretion, whether currently existing or developed at a later time. TripDoctor may utilize any Inputs in our business, including but not limited to product development, marketing, advertising, innovation or any other business activity. In doing so, TripDoctor will not incur any financial or any other type of liability or royalties or any other consideration, financial or otherwise, at the time of submission or anytime in the future.

User Provided Inputs, Data and Other Information

When using the Site, Users may, from time to time, submit, post, publish, enter, transmit, send, submit, data, information or material over which the User does not have the right, legal authority, or ownership. This may include confidential or proprietary data, information, or material that legally belongs to a third party; endorses, advocates or condones illegal activity or implies the intent to violate the law or commit a crime; is indecent, vulgar, socially unacceptable, obscene, or pornographic; does not directly pertain to the intent or business purpose of the Site; is intended to be threating, aggressive or abusive toward others; or libels, intimidates, defames, doxes, stalks, invades the privacy of, is racist, sexist, homophobic, transphobic, anti-LBGTQ+, harassing, threatening, cajoling or offensive; or seeks to exploit, traffic, sexually exploit, harm or mentally anguish others through the means of inappropriate content exposure. The User may not; violate the law, impersonate another person or entity, misrepresent their connection to any other person, group or entity, or manipulate digital signatures, or other identifiers to disguise their location or the origin of their activity; advertise or promote any non-TripDoctor business, service, or product; or solicits funds, gamble, promote gambling, solicit advertisers or sponsors; introduce malicious code or software (e.g., viruses, worms, Trojan horses) or any other types of code designed or intended to cause harm, interrupt, block destroy or limit the operation of the Site or any other website, smartphone, tablet computer software, or hardware; encourage others to conduct prohibited activity, provide or post hyperlinks to other websites that meets any of the descriptions above. TripDoctor reserves the right to determine violations to these Terms and Conditions by monitoring use of the Site and reserves the right to deny service to, block or remove any User or any information at its sole discretion. The User assumes sole responsibility for any and all content they post. The User acknowledges that, with respect to their submissions, they agree that neither TripDoctor or any third party will assume any liability for the User’s actions or lack of actions.

At its discretion, TripDoctor may provide hyperlinks on the Site in order to facilitate the User’s access to other websites which are not owned nor maintained by TripDoctor. Copywrite and Trademarks

Any and all copywrite, trademarks, logos, taglines, catchphrases, service marks and messaging appearing in the Site (collectively, the “Trademarks”) are the property of TripDoctor or a third party that provided TripDoctor the Trademarks. TripDoctor Insurance LLC (“TripDoctor”) makes this Site and its information available to anyone via the Internet or world wide web. Notwithstanding, TripDoctor retains copyright on all content, text, graphics, taglines, images and logos. A copy of the Site’s contents may be viewed and copied for a User’s personal and non-commercial pleasure; however, the full text of this Notice of Copyright appears in said copy of this Site’s content. At no time, may the contents of the Site be modified, altered or used in any way other than that expressly permitted by this Terms and Conditions. without the prior written consent of TripDoctor. TripDoctor reserves all rights, including but not limited to the TripDoctor logo, brand and service marks of TripDoctor. The names and copyrighted marks of third parties presented on the Site may be service marks owned by third party owners who retain their own rights to their own property.

Limitation of Liability

TripDoctor, its subsidiaries, parent organizations, affiliates, licensees, licensors, content or service providers, employees, contractors, agents, brokers, producers, insurance and carrier partners, officers, owners and directors will not be liable for any direct, indirect, incidental, actual, punitive, exemplary, consequential, special, or other damages, including, but not limited to loss of life, loss of income, loss or revenue, legal expenses, emotional or physical distress, pain and suffering, or any other damages, to the extent permitted by law. This applies even if the possibility of said damages relates in anyway at all to the use of TripDoctor’s Site. As permitted by law, the collective liability of TripDoctor, its subsidiaries, parent organizations, shareholders, directors, owners, employees, contractors, agents, brokers, content or service providers, insurance partners or any other party exceed the maximum of either $100 (USD) or, if the User is a Customer, the maximum amount the User paid to TripDoctor or any of its partners for the applicable service or product out of which the claim of liability originated.

TripDoctor Indemnity

The User hereby indemnifies and holds TripDoctor, its subsidiaries, parent organizations, insurance partners, affiliates, employees, contractors, licensors, content or service providers, agents, officers, and directors (the “Indemnified”) harmless and free from liability from any breach of these Terms and Conditions by the User, including any use of the Site’s content other than use that is expressly authorized in this Terms and Conditions, and any claim that User Inputs violate the intellectual property, rights of publicity, privacy rights of a third party, or defames any third party. Users agree that the Indemnified will have no liability in the event of, or the connection with, any such breach, unauthorized use or violation; and the User agrees to indemnify all and any resulting damages, loss, judgments, costs, including legal costs, awards, and expenses of the Indemnified in connection therewith. The User also indemnifies and holds the Indemnified harmless from and against any and all third-party claims, lawsuits or actions originating from the User’s use of the Site and its content.

Passwords and Security

TripDoctor emphasizes and prioritizes our User’s security and takes efforts to subvert User security very seriously. When opening an account with TripDoctor, Users set their own password and are solely responsible for the security of their password. In the event that TripDoctor provides the password, such as in the event of a temporary password provided for the pursues of allowing the User to reset their password, TripDoctor provides such passwords for the Site for the User’s personal use only, except when notified otherwise. TripDoctor relies upon the acts of any individual, organization or entity using the User’s account as coming from the User or the User’s authorization thereof. From time to time, TripDoctor may monitor account use and password security and may, at its sole discretion, require a User to change their password within specific timeframe and within certain defined parameters. TripDoctor reserves the right to terminate a User account if that User persists in using a password that TripDoctor considers insecure or if the User fails to change their password within a timeframe defined by TripDoctor. Users are prohibited from using the Site to compromise the security of, the account of, the Inputs of, the insurance application, renewal or policy of, or to alter the property of, other Users, TripDoctor or any third-party. Users are prohibited from using or distributing tools or plans intended to compromise account or Site security such as password cracking software or tools, probing tools or account login guessing tools. In the event that a User is found to be involved in any way in a violation of these Terms and Conditions, TripDoctor may, at its discretion, provide User information to other websites and organizations for the purpose of security or law enforcement. In the event of a valid legal authorization from authorized law enforcement authorities, TripDoctor may release User details to said law enforcement authorities. In the event of violations of these Terms and Conditions, TripDoctor reserves the right to fully and comprehensively investigate all suspected violations and Users involved. By using the Site, you accept these Terms and Conditions and thereby hold TripDoctor harmless to any and all claims arising from any action taken by TripDoctor or a third party as a result of investigating this violation and, when appropriate, referring such investigation to appropriate law enforcement authorities.

Severability
